During Chapter 7 bankruptcy, a trustee may collect and sell your nonexempt assets to your creditors. Under Chapter 7 bankruptcy, alimony, child support, student loans, fraudulent debts and certain taxes cannot be discharged.
Individuals must pass the California means test in order to be eligible for file for Chapter 7. If your income is higher than the median income in the state, you will have to pass the means test in order to file. If your income is too high and you do not pass the means test, you may be able to file Chapter 13 bankruptcy instead.
